EcoLearn Terms of Use
This ecolearn.com website is owned by EcoLearn in accordance with EcoLearn’s Legal Notice.
Art. 1 l Definitions
Subscriber means any User who is going to undertake a consent regarding a Brand membership action (newsletters, e-mailings, notifications, etc.).
Customer means the User who is going to contract one or more Services offered on the Site.
Terms and Conditions means the General Terms and Conditions of Use. Any other Special Conditions will be specified by name.
Brand refers to the EcoLearnBrand .
Service Providers and/or Partners refers to all independent entities: companies, freelancers, suppliers. Some entities may have contracted a partnership agreement with EcoLearn. If the Customer subscribes directly with the Service Provider and/or Partner, then the Customer shall comply with all the Terms, Pricing, and Services defined by the Service Provider and/or Partner.
Achievements means all productions made by EcoLearn or by service providers.
Services means all Intellectual, Creative and Technical Services presented and offered in the form of products, services, tools and functionalities by EcoLearn.
Site means the website, the Internet site of the EcoLearnbrand , accessible in web format via ecolearn.com.
User means any person who visits the website and/or uses the features of the ecolearn.comwebsite .
Art. 2 l Scope of application
The use of the Site is subject to compliance with the General Conditions of Access and Use detailed below and with the laws applicable in France to communication on the Internet.
The purpose of these General Terms and Conditions is to provide a legal framework for the terms and conditions for making the Site and Services available to any User, as well as the terms and conditions for accessing and using the Site and Services.

Art. 3 l Purpose of the Site
The present ecolearn.com website has been published to provide information on EcoLearn’s activities to any professional or private audience wishing to discover its themes, know its Services and/or Achievements.
The Site includes thematic content pages that may present Services, more precisely Services delivered by EcoLearn and/or Service Providers or Partners and/or Suppliers: packaged or separate offers, specific services, tools or particular functionalities. These are described in Ecolearn’s General Terms and Conditions of Sale. The use of the Site does not confer any intellectual property rights to the User, on the Services and Benefits (offers, services etc.) provided as well as on the content made available on the Site. EcoLearn makes available to any User, content whether for informational or commercial purposes.
The Site also provides tools such as surveys, simulators or tests, comparators whose resulting information is given only as an indication or information to the User on the basis of the information he will have previously provided. Thus, they have strictly no contractual value and EcoLearn shall not be held liable or even sought for erroneous information or information considered as such.
The Site also has a blog: news, agenda, directory, glossary, practical information, testimonials, etc.
Namely, all testimonials collected are subject to moderation by EcoLearn. Users are responsible for the content of their testimonials. EcoLearn shall not be held liable in any way. Any content may be removed by EcoLearn at any time, without notice, for any reason.
With respect to the directory, any registered User may request the deletion of his or her listing by e-mail to hello@ecolearn.com.
The Site provides documents such as Guides, Infographics, Diagrams, etc., downloadable or not, free or paying.
Finally, the Site provides Users with functionalities such as registration to NewsLetters, push browser consent, forms, etc. This is done in compliance with the Data Protection Policy (RGPD).
The User has the possibility to subscribe to the EcoLearn newsletter. This newsletter is used to communicate information and news from EcoLearn to any Subscriber. EcoLearn shall not be held responsible for the content of the newsletters, as they are for information purposes only.
The User may contact EcoLearn via a Contact Form accessible on the Site, in accordance with applicable data protection regulations. EcoLearn reserves the right to change the content of its Contact Form, including the manner of contact by subject matter, at its discretion.
The content of all these pages, all these documents and all these elements are made available to any User for information or commercial purposes and for the purpose of assisting the User in his or her training and sustainability skills development projects. Art. 4 l Intellectual property rights
Art. 4.1 l Rights to the EcoLearn Brand
The EcoLearn name and logo is a protected trademark. The User agrees to use, represent or reproduce the trademark in a strictly private context. Any use for commercial and/or advertising purposes is prohibited.
Regardless of the medium and its nature (web or print), any reference or reproduction or imitation or variation of the EcoLearn brand whether it is
- its Brand Identity and Communication Concept (name, url, baseline, values and elements of Brand language, etc.) ;
- its Graphic Identity (logo, acronym, signs and icons and distinctive elements of the said Brand, colors and contrasts, etc.);
- or Marketing Identity (marketing language elements, marketing values, slogans, offers, etc.), in a general way to the commercial name;
THEN, User shall make a request to EcoLearn for permission by e-mail: hello@ecolearn.com stating the background and purpose or detailed reasons for the request. The User will receive a written response from EcoLearn in return for the request.
No reproduction, even partial, representation or imitation may be made unless authorized in writing by EcoLearn. Any infringement of this obligation constitutes an offence of counterfeiting and may result in legal proceedings against the author.
In any case, the User undertakes to make a loyal use and in accordance with the laws and regulations in force of the brand, name and/or distinctive signs mentioned above and of the documents made available. The use made by any User must be lawful and not made for purposes contrary to the normal intended use to which any person may legitimately claim. The User undertakes not to reproduce any content belonging to EcoLearn in an unlawful manner or he will be held liable.
Art. 4.2 l Image rights – Personality rights
The models, performers and, more generally, all persons represented in the photos and advertising films published on this site have consented to the use of their image in the context of the campaigns produced.
In the same way, the employees and/or collaborators and/or managers of EcoLearn whose image is used on this site have consented to the use of these iconographic documents within the framework of the Site and only within this framework.
No reproduction, representation or use whatsoever of these photos and films may be made by users of the Site without the prior written consent of EcoLearn. Any use, even partial, of these documents, in violation of the above obligation, will expose its author to legal proceedings.
Art. 4.3 l Prohibition of publication of illegal content
Users of this Site are prohibited from posting Content of any kind that may glorify crimes against humanity, or incite racial hatred or child pornography, or violence or offend human dignity. In accordance with applicable law, and the provisions of the Penal Code, EcoLearn shall be obligated to report any such conduct or content to the judicial authorities.

The above obligations do not apply to journalists and press editors: EcoLearn provides them with iconographic documents and press kits that they can freely consult, reproduce and represent to illustrate their articles and press works. The User has free access to a page dedicated to the Press Area. Finally, the User may contact EcoLearn using the contact information available on this specific page or on the Site.
EcoLearn reserves the right to make any changes to the content of this page at its discretion at any time without notice or concern to the User.
Art. 5 l Hypertext links
The establishment of a hyperlink to this Site requires prior written permission from EcoLearn. If you wish to set up a hyperlink to our Site, you must therefore contact the Site Manager. EcoLearn cannot be held responsible for the availability of sites that are hyperlinked from this Site and cannot be held responsible for the content, products, services, etc. available on these sites or from these sites.
The partner page made available on the Site is for the information of Users, to ensure greater transparency and trust in the relationship with the User, whether registered or not.
These partnerships are concluded with the objective of accompanying, as best as possible, the Users, whether they are registered or not, in their training projects.

Art. 10 l Applicable Law & Disputes
These Terms of Use aregoverned by French law. In the event of a dispute or claim between the User and EcoLearn, the Parties are obliged to find an amicable solution before appearing before the competent French courts. In the event of any dispute regarding their interpretation, the French courts shall have exclusive jurisdiction.
